Dispensation of Patent Application Through PCT Belatedly Entered into National Phase
The Decision Letter of the Director General of Intellectual Property Rights No. H.01.UM.09.01 Year 2006 regarding the Dispensation of Patent Application Through PCT Belatedly Entered into National Phase (Reinstatement of Rights), stipulated that:
1. If application is applied between 30-31 months: "Chapter I&II: the document will be proceeded further, without any consequence";
2. If application is applied up to 32 months, applicant must pay additional fee in the amount of Rp. 5.000.000,00 (five million rupiah);
3. If application is applied up to 12 months (calculated since expiration of 31 months), applicant must pay additional fee in the amount of Rp. 5.000.000,00 (five million rupiah) accompanied by "Statement" letter or any evidence which explain the reason of the delay.
